At Rising Momentum, we take the privacy of our clients, website visitors, and business contacts seriously. This Privacy Policy explains how we collect, use, store, and protect personal information in connection with our services, which include paid advertising management, website creation and development, and server-side tracking implementation. By engaging our services or interacting with any of our platforms, you acknowledge that you have read and understood this policy. We have written this document in plain language to ensure full transparency about our data practices, and we encourage all parties to read it thoroughly.
By signing a Service Agreement, making a payment, or communicating approval via email or any written medium, you confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions in their entirety. We strongly encourage all Clients to read this document carefully before engagement begins, as it is designed to ensure a transparent and productive partnership.
Rising Momentum collects personal and business information through a variety of touchpoints in the course of operating our agency. When a prospective or active client contacts us, completes an onboarding form, or enters into a service agreement, we collect information such as full name, business name, email address, phone number, billing address, and any other details voluntarily provided during that process. When we are granted access to a client’s advertising accounts, website backend, or analytics platforms as part of delivering our services, we may also encounter data held within those systems, including customer data belonging to the client’s own audience. We treat such third-party data with the highest level of care and access it only to the extent necessary to perform the agreed work. Additionally, if you visit any website owned or operated by Rising Momentum, we may collect standard technical data such as your IP address, browser type, device information, pages visited, and time spent on site, through cookies and similar technologies.
The information we collect is used solely for the purposes of delivering our services, managing client relationships, processing payments, and communicating about ongoing or prospective work. We use contact details to reach out regarding project updates, invoices, proposals, and general account management. Billing information is used exclusively for the purpose of processing payments and maintaining accurate financial records. Where we have access to a client’s advertising or analytics platforms, any data encountered within those systems is used only to fulfil the specific tasks outlined in the service agreement and is never used for any purpose unrelated to the client’s own campaign or project. We may also use anonymised, aggregated performance data to inform our internal strategies and improve the quality of our services, but this will never include information that could identify an individual client or their customers.
Server-Side Tracking and Data Handling
Given that server-side tracking is one of our core service offerings, it is important that we are transparent about how data flows through the tracking solutions we implement. Server-side tracking involves the collection and forwarding of event data from a client’s digital properties to specified third-party platforms such as advertising networks or analytics tools. Rising Momentum implements these systems on behalf of clients and does not retain, sell, or independently process the event data that passes through them. The data collected through tracking implementations belongs entirely to the client, and it is the client’s sole responsibility to ensure that their use of such tracking technologies is compliant with all applicable privacy and data protection laws in their jurisdiction. Rising Momentum provides technical implementation services only and does not offer legal or compliance advice in relation to data collection practices.
Our own website and any websites we develop for clients may use cookies and similar tracking technologies to support functionality, measure performance, and inform advertising decisions. Cookies are small text files placed on a user’s device that allow websites to recognise returning visitors and gather behavioural data. Where we develop websites for clients, we build them in a way that supports cookie consent management, however it remains the client’s responsibility to configure and maintain their cookie consent solution in line with the legal requirements of their region. Rising Momentum’s own website uses cookies for analytics and operational purposes, and visitors may manage their cookie preferences through their browser settings at any time.
Sharing of Information
Rising Momentum does not sell, rent, or trade personal information to any third party under any circumstances. We may share information with trusted third-party service providers who assist us in operating our business, such as payment processors, project management platforms, and cloud storage providers, but only to the extent necessary for those providers to perform their function. All third-party providers we work with are required to handle data responsibly and in accordance with applicable privacy laws. We may also disclose personal information where we are legally required to do so, such as in response to a court order, regulatory request, or law enforcement inquiry. In such cases, we will disclose only the minimum amount of information required to satisfy the legal obligation.
Data Storage and Security
All personal and business information collected by Rising Momentum is stored securely using industry-standard measures designed to prevent unauthorised access, disclosure, alteration, or destruction. We use secure cloud-based platforms with access controls that limit who within our team can view sensitive client information. Access to client advertising accounts, websites, and other platforms is managed on a need-to-know basis and is revoked upon the conclusion of an engagement. While we take all reasonable steps to protect the data we hold, no digital system is entirely immune to security risks, and Rising Momentum cannot guarantee absolute security. In the event of a data breach that is likely to affect the rights or interests of a client or third party, we will notify the affected parties as promptly as reasonably possible and take immediate steps to contain and address the incident.
Retention of Data
Rising Momentum retains client information for as long as is necessary to fulfil the purposes outlined in this policy and to comply with our legal and financial record-keeping obligations. For active clients, data is retained throughout the duration of the engagement and for a reasonable period thereafter to allow for any post-project queries, disputes, or audits. Once data is no longer required, we will dispose of it securely. Clients who wish to request the deletion of their personal data following the conclusion of an engagement may do so by contacting us in writing, and we will action such requests in accordance with applicable data protection laws, subject to any overriding legal obligations that require us to retain certain records.
Client Data and Third-Party Audiences
In the course of managing paid advertising campaigns or implementing tracking solutions, Rising Momentum may have incidental access to data relating to a client’s own customers or website visitors. This data belongs exclusively to the client, and Rising Momentum acts purely as a data processor in relation to it. We do not access, use, or analyse this data for any purpose beyond what is required to deliver the agreed service. Clients are responsible for ensuring they have the appropriate legal basis to collect and process their own customers’ data, and for ensuring that any data shared with Rising Momentum for the purposes of campaign targeting or tracking configuration has been collected in a lawful and transparent manner.
Individuals whose personal data is held by Rising Momentum have the right to request access to that data, to request corrections where the data is inaccurate, to request deletion of their data where it is no longer necessary for us to hold it, and to object to certain types of processing. If you wish to exercise any of these rights, please contact us in writing through the official channels provided during onboarding or listed on our website. We will respond to all legitimate requests within a reasonable timeframe and in accordance with the requirements of applicable data protection legislation. Please note that in some cases, legal or contractual obligations may limit our ability to fulfil certain requests in full, and where this is the case we will explain the reason clearly.
Rising Momentum reserves the right to update this Privacy Policy at any time to reflect changes in our practices, services, or legal obligations. When we make significant changes, we will notify active clients through their primary communication channel. The date at the top of this document will always reflect when it was last revised. We encourage clients and visitors to review this policy periodically. Continued engagement with Rising Momentum following any updates to this policy constitutes acceptance of the revised version.
